No fines for Rundle Mall smokers

No one has been fined for smoking in Rundle Mall in five years.

The Adelaide City Council last issued a fine to smokers who light up in the city’s premier shopping strip in 2015.

Between 2012 – when the ban was introduced – and 2015, fewer than 40 people were issued the $62.50 fine – the maximum expiation possible for offences in Rundle Mall.

InDaily asked the council a series of questions regarding the smoking ban.

Associate director of customer and people Vanessa Godden said the council’s intent was to “continue to educate the public to make sure everyone is fully aware of the ban and to make a positive difference to people’s health, rather than focussing on issuing formal expiations” – a statement published by The Advertiser in 2015.

“When Council officers come across people smoking in the Mall, they will advise the person that Rundle Mall and the adjoining laneways are ‘no smoking’ and will then direct them to extinguish their cigarette at the nearest bin and advise that if they want to smoke they would need to go to either North Terrace, Pulteney Street, Grenfell St or King William Street,” she said.

“If they fail to extinguish their cigarettes we also advise them that it is an ‘expiateable offence.’”

Godden said the council had installed “prominent signs” at the King William and Pulteney Street entrances advising people of the ban.

She said no-smoking signs were also installed at the entrances to laneways running off the Mall, key “hot spots” and on some benches.

Under the by-law, smoking both tobacco and e-cigarettes is considered an offence.

The council last discussed the Rundle Mall smoking ban in December 2018 as part of a broader by-law review.
